Decision for Living Rivers Council vs. SWRCB

Good news!  The court issued an order and proposed statement of decision partially granting the petition in Instream Flow.  We won on the primary issue in the case — failure to analyze and disclose mitigation measures for groundwater impacts.  The order directs the Board to vacate its approval of the Policy and to recirculate, at a minimum, the portion of the SED addressing groundwater mitigation measures.  A copy of the order and decision is attached.
Attached is the text of the Court’s decision in the Northern California coastal streams case.

Judge Grillo has signed the actual order and it has been filed.
